मुंबई: भोसरी भूखंड घोटाळा प्रकरणात माजी मंत्री एकनाथ खडसे यांना मोठा न्यायालयीन धक्का बसला आहे. लाचलुचपत प्रतिबंधक विशेष न्यायालयाने त्यांचा दोषमुक्त करण्याचा अर्ज 9 डिसेंबर 2025 रोजी फेटाळला असून, या प्रकरणात गुन्हेगारी स्वरूपाचे ठोस पुरावे उपलब्ध असल्याचे न्यायालयाने नमूद केले आहे.
न्यायालयाने म्हटले आहे की, लाचलुचपत प्रतिबंधक विभागाने भ्रष्टाचार प्रतिबंधक कायद्यानुसार दाखल केलेले गुन्हे योग्य असून, तत्कालीन महसूल मंत्री खडसे व त्यांच्या कुटुंबीयांविरोधात दोषारोप निश्चित करण्यास पर्याप्त आधार उपलब्ध आहेत.
33 कोटींची जमीन 3.75 कोटींना — आणि 80 कोटींच्या नुकसानभरपाईचा प्रयत्न?
आरोपपत्रानुसार महसूल मंत्री असताना खडसे यांनी पुणे जिल्ह्यातील भोसरी (सर्वे क्र. 52/2A/2) येथील 33 कोटी रुपयांच्या जमिनीची खरेदी फक्त 3.75 कोटींना केली. या भूखंडासाठी MIDC कडून 80 कोटींची नुकसानभरपाई मिळवण्याचा प्रयत्न केल्याचे आरोप आहेत. तसेच 5.53 कोटींचा बेनामी व्यवहार झाल्याचे पुरावे तपासात स्पष्ट झाले आहेत.
ED विशेष न्यायालयाचेही समान मत — प्रकरण MP/MLA विशेष न्यायालयात
या प्रकरणावर अंमलबजावणी संचालनालय (ED) विशेष न्यायालयानेही समान निरीक्षण नोंदवले आहे. आता हा खटला पुढील सुनावणीसाठी MP–MLA विशेष न्यायालयात चालेल.
सुप्रीम कोर्टाच्या निर्देशांनुसार, लाचलुचपत प्रतिबंधक कायद्यांतर्गत दोषारोप निश्चित झाल्यानंतर एक वर्षात निकाल देणे बंधनकारक आहे. त्यामुळे खडसे व त्यांच्या कुटुंबीयांसाठी येणारा काळ अधिक कठीण ठरणार असल्याचे कायदेपंडितांचे मत आहे.
पदाचा गैरवापर, शेल कंपन्या आणि बनावट दस्तऐवज — कोर्टाचे कठोर निरीक्षण
विशेष न्यायालयाने आपल्या आदेशात म्हटले आहे की, खडसे यांनी पत्नी आणि जावईमार्फत MIDC जमीन संपादित केली. मालमत्ता बाजारभावापेक्षा खूप कमी किंमतीत खरेदी केली. विविध शेल कंपन्यांमार्फत निधी फिरवला. व्यवहार पारदर्शक दाखवण्यासाठी बनावट दस्तऐवज तयार केले. मंत्रीपदावर असताना शासकीय यंत्रणांवर दबाव टाकून बेकायदेशीर कामे केली.
न्यायालयाने स्पष्ट केले की —
“हे कृत्य त्यांच्या कायदेशीर कार्यवाहीचा भाग नव्हते; त्यामुळे खटला चालवण्यासाठी शासनाच्या पूर्वपरवानगीची गरज नाही.”
तसेच न्यायालयाने या प्रकरणातील शासकीय यंत्रणांची भूमिकाही संशयास्पद असल्याचे नमूद करत संबंधित अधिकाऱ्यांची चौकशीही होणार असल्याचे आदेशात म्हटले आहे.

या प्रकरणात सरकारतर्फे विशेष सरकारी वकिल ॲड. अजय मिसर यांनी प्रभावी युक्तिवाद केला.
